LA PLATA, BUENOS AIRES<\/p>\n<p>Id Infojus: NV7985<\/p>\n<p>S\u00cdNTESIS<\/p>\n<p>Inter\u00e9s superior del ni\u00f1o. Impugnaci\u00f3n de la paternidad. Sostiene que el presunto progenitor de una menor carece de legitimaci\u00f3n para impugnar la paternidad matrimonial habida cuenta que la ni\u00f1a es tratada como hija por el marido de la madre. Refiere que, en tal caso, es m\u00e1s beneficioso para la menor que el derecho proteja esa realidad humana, ya que el car\u00e1cter matrimonial del hijo no se encontrar\u00eda amparado por una ficci\u00f3n legal de paternidad sino por una situaci\u00f3n de hecho que tiene mayor peso y beneficio para \u00e9l.
